Civil Status Documents

Registering a foreign marriage

Whether a marriage that took place outside Spain needs to be registered with the Spanish Registro Civil — and when it does.

Last reviewed: 2026-06-15Processing varies significantly depending on the office and whether an expediente (investigation) is opened — from a few months to considerably longer in more complex cases.

Overview

A marriage that took place abroad is generally already valid in Spain without any Spanish registration, as long as it was validly performed under the law of the country where it happened. Formal registration in the Spanish Registro Civil only becomes necessary in specific situations — most commonly, when one spouse is or becomes a Spanish citizen.

Requirements

  • Registering a foreign marriage in the Spanish Registro Civil generally applies when at least one spouse is a Spanish national, or the registration is needed to support a related Spanish procedure
  • If neither spouse is Spanish, the marriage is typically recognised as valid in Spain without needing separate registration — though an apostilled, translated marriage certificate may still be requested for specific procedures like a visa application

Step-by-step process

  • Confirm whether your situation actually requires formal registration, or whether presenting your apostilled and translated marriage certificate is sufficient for what you need
  • If registration is needed, gather your original marriage certificate, apostilled and translated if not in Spanish
  • Submit the registration request to the Registro Civil Central or the Spanish consulate covering where you live, along with the required civil-status declarations
  • Attend an interview if requested, confirming the marriage's authenticity
  • Once approved, the marriage is recorded in the Spanish civil registry

Required documents

  • Original marriage certificate, apostilled and translated by a sworn translator if not in Spanish
  • Both spouses' identification and, where relevant, proof of Spanish nationality
  • Civil-status declarations as requested by the Registro Civil

Common mistakes

  • Assuming every foreign marriage needs Spanish registration — many foreign couples never need this step at all
  • Submitting a marriage certificate that hasn't been properly apostilled or translated, causing delays

Practical tips

  • If you simply need to prove you're married for a specific procedure (a visa, a tax matter), check first whether your apostilled and translated certificate alone is enough, since that's often faster than full registration
  • If a Registro Civil opens an expediente to verify the marriage further, this is a standard precaution, not necessarily a sign of a problem with your case
